These Terms of Service (the “Terms”) establish the terms and conditions for using the application “Syncount” and its associated widgets, Apple Watch applications, and web services (collectively, the “Service”) provided by WKHack LLC (“we,” “us,” or “our”). All users of the Service (“Users”) must agree to these Terms before using the Service.
Article 1 (Scope of Application)
These Terms apply to all relationships between Users and us regarding the use of the Service.
Rules, notices, tutorials, etc., posted by us within the Service constitute a part of these Terms.
Article 2 (User Information and Account Management)
Users may voluntarily set profile information such as usernames when using the Service.
For cloud synchronization and data backup, the Service utilizes Apple IDs (iCloud) and device-specific identifiers.
Users are responsible for managing this account information at their own risk.
We may consider any actions taken using a User’s account as actions taken by the User themselves.
Article 3 (Premium Plan and In-App Purchases)
The Service is generally free to use, but we offer a paid “Premium Plan” to unlock additional features and remove limitations (such as unlocking widget display items and using limited theme colors).
Purchases, payments, and restorations for the Premium Plan are processed through the App Store payment system (StoreKit) provided by Apple Inc.
Conditions regarding billing, payment methods, and auto-renewing subscriptions are subject to App Store regulations and instructions on the purchase screen.
Due to the nature of digital content, cancellations or refunds after purchase are not accepted unless required by law.
Article 4 (Data Sharing Between Users)
The Service includes a feature allowing Users to share their created counter data with other users using invitation codes.
Shared data (counter names, logs, tags, user icons, etc.) can be viewed, used, and modified (e.g., changing counts) by the recipient users.
Users are responsible for managing invitation codes and sharing settings.
We bear no responsibility for unintentional sharing or any disputes arising between Users and sharing recipients.
Article 5 (Prohibited Acts)
When using the Service, Users must not engage in the following acts:
- Acts violating laws, court judgments, or public policy.
- Acts infringing upon copyrights, privacy rights, or other rights or interests of us, other users, or third parties.
- Unauthorized collection, accumulation, sharing, or disclosure of personal or confidential information.
- Acts placing an excessive burden on the Service’s network or servers, or attempting unauthorized access.
- Reverse engineering.
- Unauthorized unlocking of features.
- Acts for sales, propaganda, advertising, solicitation, or other commercial purposes (except as approved by us).
- Other acts we deem inappropriate.
Article 6 (Disclaimer)
We do not expressly or impliedly guarantee that the Service is free from factual or legal defects (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, or bugs).
We are not responsible for the content, continuity, or accuracy of services provided by third-party providers. We shall not be liable for any damages incurred by Users arising out of the Service, unless such damages are caused by our intent or gross negligence. Even when we are liable, our liability for damages shall be limited to damages that would ordinarily occur.
We bear no responsibility for the loss, leakage, or corruption of data exported outside the device using the Service’s features (such as CSV export).
We are not obligated to compensate for data inconsistencies or loss caused by communication failures, device malfunctions, OS updates, or synchronization delays of Apple Watch or widget features.
Article 7 (Suspension of Service Provision)
We may suspend or interrupt the provision of all or part of the Service without prior notice to Users if we determine any of the following exist:
- Performing maintenance, inspection, or updates of computer systems related to the Service.
- Provision of the Service becomes difficult due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters.
- Provision of the Service becomes difficult due to troubles or specification changes of cloud service providers (e.g., Apple Inc., Google LLC).
- Any other case where we deem it difficult to provide the Service.
Article 8 (Use by Minors)
If a minor uses the Service, they must obtain the consent of a legal representative (such as a person with parental authority) beforehand, including for purchasing the Premium Plan and using the data sharing features.
Article 9 (Changes to the Terms)
We may amend these Terms when deemed necessary.
In the event of significant changes, we will notify Users via in-app notifications or by posting on our website.
If a User starts using the Service after a change to these Terms, the User shall be deemed to have agreed to the modified Terms.
Article 10 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by the laws of Japan.
For any disputes arising in relation to the Service, the court having jurisdiction over the location of our head office shall be the exclusive agreement jurisdictional court.
